THE SITE IS PROVIDED BY American Gas & Chemical Company Ltd. (AGC) ON AN "AS IS" AND "AS AVAILABLE" BASIS. AGC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO (1) THE OPERATION OF THE SITE, (2) THE QUALITY, ACCURACY, COMPLETENESS OR VALIDITY OF ANY MATERIALS ON THE SITE, OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED ON THE SITE, OR (3) WHETHER THE FUNCTIONS CONTAINED ON THE SITE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT DEFECTS WILL BE CORRECTED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF TITLE, IMPLIED WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. NEITHER AGC NOR ITS AFFILIATES REPRESENTS OR ENDORSES THE ACCURACY, TIMELINESS OR RELIABILITY OF ANY ADVICE, OPINION, STATEMENT OR OTHER INFORMATION DISPLAYED, UPLOADED OR DISTRIBUTED THROUGH THE SITE. YOU ACKNOWLEDGE THAT ANY RELIANCE ON ANY SUCH OPINION, ADVICE, STATEMENT OR INFORMATION WILL BE AT YOUR SOLE RISK. NEITHER AGC NOR ITS AFFILIATES IS RESPONSIBLE OR LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR OTHER INDIRECT DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR THE INFORMATION CONTAINED ON THE SITE, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL LIABILITY OF AGC OR ITS AFFILIATES TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION RESULTING FROM YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE, EXCEED ONE DOLLAR (US$1.00). CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

PRODUCT WARRANTIES AND LIMIT OF LIABILITIES

Merchandise purchased under this order is warranted against defect of material or workmanship under normal use and service for such periods of time as are specified in AGC’s standard warranty terms in effect at a time of shipment, which terms are available upon request. AGC’s liability under this warranty is limited solely to replacement or repair, at AGC’s option, of the defective material. This warranty shall not apply to any product or part which has been subjected to misuse; abuse; improper installation or application, attempted or unauthorized repair, alteration, accident or negligence in use,storage, transportation, or handling.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Buyer must notify AGC in writing of all claims under this warranty within thirty (30) days of discovery of the defect giving rise to such claim.

All return shipments must be authorized in writing by AGC prior to shipment and shipment will be at Buyer’s expense. AGC will not, under any circumstance, whether as a result of breach of contract of breach of warranty, be liable for consequential, incidental, special, or other damages including but not limited to loss of profits or revenues, loss of use or damage to any associated equipment, facilities or services or downtime costs.

TYPOGRAPHICAL ERRORS

While we make every effort to provide accurate information, inaccuracies or errors may occur, including price information and product specifications. In the unlikely event that there is a typographical error, we will, at our discretion, either contact you for instructions before shipping, or cancel your order and notify you about the cancellation. AGC reserves the right to correct any errors, inaccuracies or omissions, including after an order has been submitted and whether or not the order has been confirmed and your credit card charged.

CONDUCT OF USERS

You agree that you will not: (i) transmit via or through the Site any information, data, text, files, links, software, chat, communication or other materials that is or that AGC considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, racially or ethnically hateful or otherwise objectionable; (ii) attempt to transmit any "virus," "trojan horse" or other software destruction or disruption device; (iii) intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to, any regulations having the force of law while you are using or accessing the Site or in connection with your use of the Site, in any manner; and (iv) invade the privacy or violate any personal or proprietary right (including intellectual property rights) of any person or entity.

MINORS

We do not knowingly provide services or sell products to children. We sell products intended for industrial and commercial use and they are not intended for use by minors for safety reasons. If you are below the age of 16 you may use our website only with the permission and active involvement of a parent or legal guardian.

GOVERNING LAW

This Agreement, and all claims or causes of action (whether in contract, tort or statute) that may be based upon, arise out of or relate to this Agreement, or the negotiation, execution or performance of this Agreement (including any claim or cause of action based upon, arising out of or related to any representation or warranty made in or in connection with this Agreement or as an inducement to enter into this Agreement), shall be governed by, and enforced in accordance with, the substantive internal laws of the State of New Jersey, including its statutes of limitations.

SETTLEMENT OF DISAGREEMENTS

In the event of a dispute, controversy or claim arising out of or relating in any way to the agreement or the use of the product purchased, the dispute shall be settled by binding arbitration administered by and in accordance with the rules of the American Arbitration Association. The number of arbitrators shall be three. The place of arbitration shall be New Jersey. New Jersey law shall apply. Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.

PAYPAL CANCELLATIONS

If you use Paypal to place an order and then cancel the order, we will charge you Paypal's processing fee  (no more, no less). The fee is variable based on the size of the order. This amount will be deducted from your refund.
